TERMS AND CONDITIONS - LOLA CARAVAN BAR
DEFINITIONS
The name Lola Caravan Bar refers to Shailer Farms Ltd T/A Lola Caravan Bar, Keith and Annette Shailer are owners and directors.
When Lola Caravan Bar is used this always refers to the legal entity as stated above. “We”, “Us”, “Our”, and “Company” also refer to the legal entity.
“You”, “Your”, “Hirer”, “Customer”, and “Client” means the customer named in the quote and or invoice.
1 TERMS
1.1 The terms and conditions apply to the hire of Lola Caravan Bar and any equipment and or product supplied or used for the event requested by the “Client” or relevant to provide the service that has been booked.
1.2 Nobody other than a company director is authorised to waive or change our terms and conditions, waivers or changes are only valid if written and signed by a director of the company.
1.3 These terms and conditions override any conditions made verbally
2 BOOKING CONFIRMATIONS
2.1 Bookings are only confirmed after the deposit amount has been received into our nominated bank account.
2.2 Dates can not be held or reserved unless a deposit has been paid.
2.3 A written quote will always be supplied, any changes we accept will be amended and an updated quote or invoice will be provided to you.
2.4 Prices are subject to change.
3 FEES AND PAYMENTS
3.1 A booking/deposit fee is required to confirm any booking, this is deducted from your final payment amount, the booking/deposit fee is non-refundable.
3.2 A bond may be requested and is payable no later than 14 days prior to the event date
3.3 If a bond has been requested this will be refunded if there is no damage breakages to Lola Caravan Bar or any equipment and or product.
3.4 Final and full payment is required to be paid no later than 14 days prior to the event date.
3.5 You are responsible for any broken, damaged or missing glassware, this will be invoiced to you within 14 days after your event and due to be paid immediately, broken, damaged or missing glassware is charged as follows: These prices are inclusive of GST.
Tumblers / White Wine / Red Wine / Flutes $ 7.50 each
Coupe or Cocktail Glasses $15.00 each
3.6 Replacement costs of damaged or missing equipment or product other than glassware as stated above will be charged out based on current retail value, or the cost to repair. This will be invoiced to you and payment will be due immediately.
3.7 Equipment and or product refers to, but is not limited to:
A Lola Caravan Bar
B Vehicles
C Equipment
D Glassware
E Decor Items
F Coffee Machine and Grinder
3.8 If an invoice is not paid in full by the due date of this invoice Lola Caravan Bar has the right to cancel the contract with no compensation of any kind to the customer.
3.9 If we are providing an 8 hour service and travel time is more than 2 hours each way we will need to have accommodation for the night of the event, this will be discussed prior to the event and you agree to reimburse us for accommodation costs.
4 ARRIVAL / SET UP AND PACK DOWN / REMOVAL
4.1 We will arrive to commence set up of the caravan and any equipment as per the quote at least one hour prior to the service Start time.
4.2 Pack down will commence with us being ready to leave the event within half an hour of the service finish time.
4.3 Appropriate vehicle access to and from the site must be provided
4.4 You may at times be required to assist with getting the caravan into place and attaching to the vehicle at the end of the event.
5 CANCELLATION POLICY
5.1 The following charges may apply if the event is cancelled, all cancellations must be in writing.
5.2 Cancellation 30 days or less prior to the event will be required to pay the full and final invoice.
5.3 Cancellation with 31 days or more notice can postpone the event to another date within 12 months of the original event date, this is subject to availability
5.4 Deposit is Non Refundable for any and all cancellations
6 WARRANTIES AND LIMITATION OF LIABILITY
6.1 Lola Caravan Bar will not take any responsibility if we are unable to access the property/site.
6.2 The customer understands and agrees that Lola Caravan Bar shall not be responsible or held liable in the event that Lola Caravan Bar is prohibited from providing services due to illness, hospitalisation, motor vehicle accident, transportation breakdown, traffic difficulties/delays, road closures, extreme or dangerous weather conditions, or any other unforeseen incapacitation or other cause of non-arrival on the event day.
6.3 Lola Caravan Bar shall not be held liable (including negligence) in any way whatsoever to the customer or any third party for any loss or damage whatsoever, whether directly or indirectly, special or consequential. Lola Caravan Bar takes no responsibility for injury to any party through breakages or items or any accidents during the hire period.
6.4 If at any time we feel there is a risk to staff and or equipment/property Lola Caravan Bar has the right to cancel the contract immediately and vacate the premises with no compensation of any kind to the customer.
7 HIRE PERIOD
7.1 The hire period will be specified in the written quote.
7.2 The hire date, time and location may not be changed without contacting
Lola Caravan Bar to determine if such changes are possible.
8 OWNERSHIP
8.1 Ownership of Lola Caravan Bar and all property, equipment and product associated with us remains with Shailer Farms Ltd T/A Lola Caravan Bar, ownership does not and will not transfer or pass to any other party.
8.2 Lola Caravan Bar reserves the right to take/use/release all photographs, video footage or other recordings in which Lola Caravan Bar are in or part of. The customer agrees to pass on all photographs of Lola Caravan Bar for viewing and/or to be used for promotional purposes on our website and or social media, the customer acknowledges that this is for promotional purposes only and will not expect or receive compensation of any kind, there is no expiration period for this permission.
